§ 1 Scope

These Terms and Conditions apply to the use of this platform by visitors, prospects, and applicants. By using the platform, you agree to these Terms and Conditions.

§ 2 Platform Operator and Technical Service Provider

This platform is operated by the company named in the Legal Notice (hereinafter "Operator"). The Operator is responsible for all content published on this platform, offers, and the handling of rental agreements.

The technical platform "Roomz" is provided by Bredow Systems, Jan Christopher Bredow, Wandsbeker Chaussee 74, 22089 Hamburg (hereinafter "Technical Service Provider"). The Technical Service Provider exclusively provides the software and has no influence on the content, prices, conditions, or decisions entered by the Operator.

If the Operator uses the hosted version of Roomz, the Technical Service Provider handles hosting and data backup of the platform. Content responsibility remains entirely with the Operator.

If the Operator uses a self-hosted version of Roomz, full responsibility for hosting, data backup, data protection, and availability lies with the Operator. The Technical Service Provider assumes no liability whatsoever in this case.

§ 3 Platform Services

The platform allows prospects to view available rental properties, access information about amenities and prices, and submit inquiries or applications to the Operator.

Using the platform or submitting an inquiry does not establish a rental agreement. A rental agreement is only established through a separate rental contract between the Operator and the tenant.

§ 4 Room Representations and Deviations

The room images and descriptions shown on this platform serve as reference representations and comparative images. The actually assigned room may differ from the room shown.

Deviations may occur for the following reasons in particular:

• Construction or renovation work
• Maintenance measures
• Mold remediation or moisture damage
• Pest control
• Accidental double occupancy
• Different furnishing or equipment
• Different room layout within the same room category
• Other operational reasons

The Operator reserves the right to assign a comparable room of the same category. There is no entitlement to a specific room unless expressly agreed in the rental contract.

§ 5 Liability of the Operator

The Operator is responsible for the accuracy and currency of the content published on this platform. Despite careful review, no guarantee can be given for the completeness, accuracy, and currency of the information provided.

The Operator is not liable for damages arising from the use or non-use of the information presented on this platform, unless demonstrably intentional or grossly negligent fault is present.

§ 6 Liability of the Technical Service Provider

Bredow Systems as Technical Service Provider exclusively provides the software platform "Roomz" and assumes no liability for:

• Content, images, prices, or descriptions entered by the Operator
• The accuracy, completeness, or currency of platform content
• Decisions by the Operator regarding inquiries, rental agreements, or assignments
• Legally binding agreements between the Operator and users/tenants
• Compliance with local laws and regulations by the Operator
• Damages caused by the Operator's configuration of the platform

For the hosted version, the Technical Service Provider strives for high availability and regular data backup, but does not guarantee uninterrupted accessibility or complete data recovery.

For a self-hosted version, the Technical Service Provider bears no responsibility whatsoever for availability, data backup, data protection, and security of the installation.

§ 7 Data Protection

§ 8 Changes to Terms

The Operator reserves the right to change these Terms and Conditions at any time. The current version is always available on this page. By continuing to use the platform after changes to the Terms, you agree to the modified conditions.

§ 9 Severability Clause

Should any provision of these Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.
